It depends on what you received. A 3-Day Notice to Pay or Quit gives you 3 calendar days to pay rent or vacate — this is before a lawsuit is even filed. A Notice to Vacate (30, 60, or 90-day) begins the termination process — you may have grounds to respond or request accommodation. Once a landlord files a lawsuit and you are served with a Summons and Complaint, you have 10 court days (excluding weekends and holidays) under AB 2347 to file a formal response — or risk an automatic default judgment. If a judgment has already been entered against you, a Stay of Execution may delay enforcement while you pursue other remedies. Always verify current deadlines with the Alameda County Superior Court clerk at (510) 891-6000.

Most eviction cases in California go through several stages before a judge makes a final ruling. Understanding each stage helps you stay ahead of deadlines and arrive prepared.

1. Notice Period — The landlord serves a 3-Day Notice to Pay or Quit, Notice to Vacate, or other termination notice. This is your first opportunity to respond, pay, or document your position.

2. Unlawful Detainer Filed — If you don't comply with the notice, the landlord files an eviction lawsuit. You are served with a Summons and Complaint. You now have 10 court days to file a written response or risk a default judgment.

3. Answer Filed — Your written response to the court sets out your position and any defenses. This is one of the most important documents in your case — and one we help prepare.

4. Settlement Conference — Before trial, most courts schedule a settlement conference where both sides meet to try to resolve the matter. Arriving organized and prepared makes a significant difference.

5. Trial — If no settlement is reached, the case goes before a judge. Your organized paperwork, declarations, and evidence are what the judge reviews.

6. Judgment / Stay of Execution — If a judgment is entered against you, a Stay of Execution may delay enforcement while you pursue other remedies. We prepare this paperwork as well.

How we fit in: Most legal aid services are capacity-limited, income-restricted, and time-pressured. We prepare and organize your paperwork before your hearing so that when you connect with a legal aid attorney — at the courthouse or at a clinic — they can focus on legal strategy rather than helping you locate documents.
